AWEsum Care’s products and services are provided by DocPro Services Limited (the “Company”).  The Company operates under and is part of the DocPro group of companies (“DocPro Group”). The Company recognizes its responsibilities in relation to the collection, holding, processing , use and/or transfer of personal data under the Personal Data (Privacy) Ordinance (Cap. 486) (“PDPO”)

This Personal Information Collection Statement (“PICS”) applies to the information that we collect as you use our AWEsum Care mobile application and website (the “Platform”) or purchase products and/or services from the Platform.

Please note that if you do not provide us with your personal data, we may not be able to provide the information, products or services you need or process your request on the Platform.

1. Purpose: 

From time to time it is necessary for the Company to collect your personal data which may be used, stored, processed, transferred, disclosed or shared by us for the purposes (“Purposes”), including:

(a) performing our agreement with you to provide content and services on the Platform, including the creation of legal self-help documents, as well as providing, improving and developing our products and services; 

(b) researching, designing and launching new platforms, products, services document templates, legal forms or features; 

(c) providing you with alerts, updates, materials or information about our services or other types of information that you requested or signed up to; 

(d) sending to your attorney / executor / beneficiary / contact at your request for the purpose of notification; 

(e) exercising our rights under our contracts with you, including collecting amounts outstanding from you; 

(f) responding or taking part in legal proceedings, including seeking professional advice, or for the purposes of the legitimate and legal interests of the Company or a third party (e.g. the interests of our other customers); 

(g) compliance with any law, regulation, judgment, court order, voluntary code, sanctions regime, within or outside Hong Kong existing currently and in the future or other legal obligations that we are subject to;

(h) communicating with you and responding to your questions or requests; 

(i) researching, customer profiling and segmentation;

(j) analysing how you access and use our platforms, products and services including those available on our websites and apps;

(k) advertising and marketing our platforms, products and services and other related subjects;

(l) determining the amount of indebtedness owed to or by you;

(m) complying with any obligations, requirements, policies, procedures, measures or arrangements for sharing data and information within the DocPro Group and/or any other use of data;

(n) facilitating consolidated supervision of the DocPro Group for the conduct of internal audit and the performance of risk management;

(o) responding to any legal, governmental, or regulatory or quasi-governmental related matter, action or proceeding (including any prospective action or legal proceeding);

(p) making or investigating any claim or responding to any search or document request, including but not limited to action, proceeding, request from government authorities, Hospital Authority or the Law Society of Hong Kong; 

(q) providing analytics by third party on our behalf via the Platform which are aggregated or de-identified information with third parties, which cannot reasonably be used to identify you;  

(r) processing Personal Data with our strategic partners to provide products and services, or that help us market to customers (including, but not limited with DocPro Group on document creation service and a third-party provider on optical character recognition technology);

(s) review the Personal Data from time to time to identify problems and solve disputes, to identify users who use multiple user identifications or aliases, and to compare and review your Personal Data for errors, omissions and accuracy;

(t) introduce, provide and market to you the Company, other companies of the DocPro Group or the company’s business partners (subject to your consent, see section 3 below) of the products/services, and the provision, maintenance, management and operation of such products/services;

(u) purposes directly related or incidental to the above; or

(v) where you have given consent to it.

2. Transfer of personal data:  

Personal data will be kept confidential but, subject to the provision of any applicable law, may be provided to:

  1. the DocPro Group and includes our overseas offices, affiliates, business partners and counterparts (on a need-to-know basis only). In the event of a reorganization, sale or merger we may transfer personal ata to the relevant or proposed transferees of our operations (or a substantial part thereof) in any part of the world.
  2. our third party providers that provide customer support services, optical character recognition, artificial intelligence or big data technology in connection with the documents, products, content and services distributed via us.
  3.  with our third party network providers that provide content delivery network services and server services in connection with us. 
  4. with our personnel, agents, advisers, auditors, contractors, financial institutions, and service providers in connection with our operations or services; persons under a duty of confidentiality to us; or persons to whom we are required to make disclosure under applicable laws and regulations in any part of the world.
  5. any doctor, lawyer agent, contractor or third party who provides administrative, technology, witnessing or other professional services (including direct marketing services) to the Company and/or our affiliates who have a duty of confidentiality to the same. 
  6. We may allow you to link your User Account to an account offered by a third party. If you consent to link the accounts, we may collect and combine information you allowed us to receive from a third party with information of your User Account to the degree allowed by your consent at the time. If the linking of the accounts requires the transmission of information about your person from us to a third party, you will be informed about it before the linking takes place and you will be given the opportunity to consent to the linking and the transmission of your information. The third party’s use of your information will be subject to the third party’s privacy policy, which we encourage you to review.

Your personal data may be provided to any of the above parties who may be located in Hong Kong or outside of Hong Kong, and in this regard you consent to the transfer of your data outside of Hong Kong.

3. Use of Personal Data for Direct Marketing Purposes: 

The Company is only allowed to (i) use your personal data in direct marketing; or (ii) provide your personal data to another person or company for its use in direct marketing, if you provide your consent or do not object in writing.

The Company intends to:

  1. use your name, contact details (such as phone number, email address and mailing address), gender,  products and services information, pattern and behaviour, financial background and demographic data held by the Company from time to time for direct marketing;
  2. Conduct direct marketing in relation to the following classes of products and services that the Company, our affiliates and our co-branding partners may offer:
  • elderly care services and products;
  • insurance services and products;
  • wealth management services and products;
  • pensions, retirement plans, investments, brokering, financial advisory, credit and other financial services and products; 
  • media, entertainment and telecommunications services; and
  • donations and contributions for charitable and/or non-profit making purposes; 

(c) The above products and services may be provided by the Company and/or:

  • any of our affiliates;
  • third party financial institutions;
  • the Company, our affiliates and our co-branding partners providing the products and services set out in (b) above; and
  • external service providers supporting the Company or any of the above listed entities in providing the products and services set out in 2.

(d) In addition to marketing the above products and services, the Company also intends to provide the data described in (a) above to all or any of the persons described in (c) above for use by them in marketing those products and services, and the Company requires your written consent (which includes an indication of no objection) for that purpose;

Before using your personal data for the purposes and providing the transferees set out above, the Company must obtain your written consent, and only after having obtained such written consent, may use and provide your personal data for any promotional or marketing purposes.

You may in future withdraw your consent to the use and provision of your personal data for direct marketing,

If you wish to withdraw your consent, please inform us in writing to the address in section 4 below. The Company shall, without charge to you, ensure that you are not included in future direct marketing activities.

4. Access and correction of personal data: 

You have the right:

(a) to check whether we hold data about you and to request access to such data;

(b) to require us to correct any data relating to you which is inaccurate;

(c) to ascertain our policies and practices in relation to data and to be informed of the kind of personal data held by us;

(d) in relation to uploaded documents, to delete the uploaded documents or to change the access rights of others to your uploaded documents.

In accordance with the provisions of the PDPO, we have the right to charge a reasonable fee for the processing of any data access request.

While we review any request sent by mail, please be aware that to combat fraud, harassment and identity theft, the only way to access, rectify or delete your data is through logging in with your User Account at the AWEsum Care App or website.

This Statement was last updated on 1 March 2022 (“Revision Date“). If you were a user before the Revision Date, it replaces the existing Personal Information Collection Statement.
